Weekly Memberships Terms & Conditions

Welcome to Keyboardkidz. On signing your Membership Application Form, these Terms and Conditions and your Membership Application Form will constitute your Membership Agreement with us. You should only sign your Membership Application Form if you have read, understand and agree with these Terms and Conditions.

Definitions

You, Your – Refers to the person named on the Membership Application Form.

We, Us – Refers to Keyboardkidz Pty Ltd (ABN 69125223181), and any other related body corporate or any future nominee.

Direct Debit Authority – means your authorisation for the third-party payment processer Ezypay to periodically draw funds from the account or credit card listed on your Membership Application Form to pay all your liabilities under this Membership Agreement.

Fixed-Term – means the minimum membership term for the relevant Membership Plan which you specified when choosing the Membership type prior to completing the Membership Application Form.

Periodic-Membership – means the that membership term has met the minimum 6-month Fixed Term membership agreement and has rolled over into periodic weekly payments. You are no longer bound by the fixed term agreement.

Membership Fees – means the fees advised to you by us for the relevant Membership Plan specified in the Membership Details section of your Membership Application Form as varied from time to time by these Terms and Conditions.

Length of Membership

My acknowledgement that:

  1. All memberships have a minimum fixed-term membership of 6 months which begins automatically when choosing your relevant Membership Plan and completing the sign-up process.
  2. Memberships can be selected in either 20-minute or 30-minute lesson durations as part of each Membership Plan.
  3. You must agree to a weekly day, time and location that will be offered to you before proceeding with your membership.
  4. The scheduled lesson time is to remain the same each week for the remainder of the Fixed-Term Membership period unless we agree to offer an alternative time based on our availability.
  5. A Membership plan can only be amended to a different plan within 14 days from Membership signup e.g. upgrading from 20-minute lessons to 30-minute lessons or downgrading from 30-minute lessons to 20-minute lessons.

Your Membership

Membership Plan:

 My acknowledgement that:

  1. At the expiry of the Fixed Term your Membership Plan will be automatically be transferred to a Periodic Membership and you will be liable to pay your Membership Fees for the Periodic Membership weekly in advance. You acknowledge those Membership Fees may vary in accordance with Section 5 xi
  2. If you do not want your Membership Plan to be automatically transferred or renewed, then you must provide us with written notification of cancellation 4 weeks prior to it expiring.

Membership Cancellations:

 My acknowledgement that:

  1. If your Membership Plan is Fixed Term you may cancel your membership subject to full fees owed for the remainder of the outstanding balance of the Fixed Term membership period.
  2. If you are on Periodic Membership then you may cancel this Membership Agreement at any time, however:
  3. Notice of intention to cancel must be given to the Managing Director of Keyboardkidz with a minimum of four (4) weeks written notice (in advance). Confirmation of your intention to cancel will be sent via email before the four-week cancellation period can commence.
  4. You are not entitled to a refund of any Membership Fees paid for services rendered; but
  5. No cancellation fees apply, and any free resources obtained through the membership are yours to keep.
  6. By cancelling the Fixed Term Membership or Periodic Term Membership you forfeit all Membership inclusions, including:
    1. Books
    2. Exam Enrolment
    3. Brisbane Piano Festival Registration
    4. End of Year Concert Registration
  7. All Instalments as at the date of cancellation must be paid in full;
  8. If you cancel your membership and then want to resume lessons less than 3 months later, we reserve the right to charge a re-establishment fee. This fee will be based on the time elapsed and it at the discretion of Keyboardkidz.

Membership Inclusions:

 My acknowledgement that:

  1. Lessons – One lesson per week is included in the Membership at the scheduled location, day and time.
    1. Lessons are only held during the four (4) school terms per year based on the Queensland State Primary School Year. A calendar is available at www.keyboardkidz.com.au and in the student diary.
    2. Lessons are not held on public holidays, pupil free days or Queensland School Holidays.
  2. Music Books – Course books and all books required for exams will be issued as required. The student’s teacher will order the required books, and these will be posted via express post.
  3. Exam fees – We will cover the cost of your child’s exam fees provided the following criteria have been met:
    1. Your child has met the minimum exam suitability requirements as determined by the teacher.
    2. That a suitable location, date and time for the exam has been selected and confirmed in advance by you.
      1. All exams are held through the AGME (guildmusic.edu.au Australian Guild of Music Education).
      2. If you do not attend the scheduled exam or you wish to reschedule after agreeing to the original location, date and time then you will not be entitled to a refund or rescheduled appointment. If you wish to re-sit that exam level, then you may be required to pay the full exam fee. Unless:
        1. If your child has a medical certificate for that day, then the exam can be rescheduled for 50% of the regular exam fee. This is not covered by your membership and must be paid for by you prior to the next agreed scheduled exam location, date and time.
    3. You may elect to sit a Video exam. Video exams are available at an extra $25 fee which is not covered by your membership.
    4. Exam fees are included as part of the membership and are not transferrable or refundable even if the child does not participate.
  4. Concert Fees – Your membership includes your child’s registration fees for both the Brisbane Piano Festival and the Keyboardkidz’ End of Year Concert provided the following criteria have been met:
    1. You must register your child via the online registration form on the Keyboardkidz website before the closing date.
      1. The closing date will be publicly visible on the website.
    2. Any additional tickets for adult and child spectators are not covered by your membership and these tickets must be purchased separately.
    3. If the student does not attend the Brisbane Piano Festival or the Keyboardkidz’ End of Year Concert you will not be entitled to a refund as we encourage all students to participate.

General

  1. If you do not attend a lesson for any reason you are not entitled to a makeup lesson or any refund.
  2. You can choose to do a makeup lesson for any unattended lessons at a charge of 50% of the regular weekly fee. You will be sent an invoice and it must be paid prior to the scheduled make up lesson and is subject to our availability. This can only be arranged through the office within 1 week of any unattended lesson.
  3. If you need to take extended time off (3 – 6 weeks during school terms only), notice must be given via email to us prior to the commencement of that current school term. You will continue to pay the weekly membership fee but in turn we will keep your reserved time. You are welcome to make up the missed lessons when you return at a time and location convenient to Keyboardkidz and subject to our availability.
  4. If your weekly fees fall into arrears, we reserve the right to immediately suspend lessons. Any missed lessons will not be made up.
  5. We will avoid moving your lesson day/time unless absolutely necessary. If we cannot find you an alternative day/time, you are entitled to cancel your membership immediately.
  6. If we need to cancel an individual lesson, at your discretion, we will either:
    1. Refund you a single weekly payment directly to a nominated bank account of your choice  or
    2.  Schedule a makeup lesson at no charge.
  7. If you arrive at a scheduled lesson and the teacher is not present, you will be refunded 1.5 times your weekly fee price to make up for the inconvenience we have caused.
  8. After School Care – If a child attends After School Care parents must arrange with After School Care to have their child brought to their lesson. They should arrive 5mins before the scheduled time.  Keyboardkidz will not be responsible if After School Care fails to bring your child to their lesson.  Our teachers will endeavour to contact After School Care but cannot leave the teaching room to collect them. The office will let you know if After School Care is late or fails to bring your child to their lesson.
  9. Student Behaviour – This is a very small issue but when it does arise it is a big issue for the teacher. Children must behave during their piano lessons. It is not our teachers’ job to discipline children and if they are not able to behave in a suitable manner and take instruction, we will contact you to remedy the situation. If your child’s behaviour does not improve lessons may be suspended without refund.
  10. Home Instrument – Parents must ensure their child has a suitable instrument for their child to practice on at home. Failure to do so can result suspension of lessons with no refund for missed lessons.
  11. There will be an annual fee increase on 26 January which we will notify you via email at least 4 weeks prior.
  12. We reserve the right to update or change these terms and conditions at any time, you will be notified by email if this is to occur.

If Ezypay is cancelled but you are still under contract, then you are still obligated to pay the remainder of the contract period. At any point the amount, frequency and date of the periodic direct debits may change. If changes are expected we will provide notice to the change in amount, frequency or date of the periodic direct debit payments. I authorize Keyboardkidz to increase the rates of its fees and charges without prior notice on the 31st December each year by CPI or 5%, whichever is greatest. Refunds or liability due to faults outside of Keyboardkidz control. Fraud, security, environmental disaster, failure of technology etc.

Pay Per Term Terms & Conditions

1. Our teaching terms are based on the Queensland State Primary School Year. A calendar is available in the student diary and online here. It includes term dates, school holidays, pupil free days, public holidays, early payment dates and final due dates for term fees.

2. Lessons are to be paid in full one school term in advance. Your account will be mailed to you three (3) weeks before the early payment due date. In order to be entitled to the early payment discount, payment must be received on or before the early payment due date. This means payments made via post or Internet Funds Transfer should be done a few days before to ensure that payment is received on or before the due date.

3. Once the school term has commenced you are obligated until the end of that term.

4. No refunds for term lessons will be given.

5. Lessons are not held during school holidays or on public holidays or pupil free days. You will not be charged for these lessons and your term account will be adjusted to reflect this.

6. You do not need to re-book every term as your lesson time and day will remain the same.

7. You do need to notify us if you are not continuing. This notice should be given in writing by email or a letter before the conclusion of the current term.

8. Lessons missed for any reason will be charged for in full. You are not required to give any notice.

9. Make up lessons are available for any unattended lessons. A charge of 50% of the regular lesson fee must be paid for prior to the scheduled make up lesson. This can only be arranged through the office within 2 weeks of the unattended lesson.

10. If you need to take an extended time off (3 or more weeks), notice must be given prior to the commencement of the term and you have the following choices. Option 1: Pay for the missed lessons, and in turn you will keep your reserved time. You are welcome to make up the missed lessons at 50% of the normal price. Option 2: Cancel the lessons, but lose your reserved time.

11. Lessons will be suspended if your account falls into arrears, and you will lose your reserved lesson time.

12. We will avoid moving your lesson unless absolutely necessary. If we cannot find you an alternative time, you are entitled to a refund of the balance of any prepaid lesson fees.

13. If we need to cancel a lesson, that lesson (at your discretion) will either be: a) credited to your account or b) rescheduled as a makeup lesson at no charge.

14. If you arrive at a scheduled lesson and the teacher is not present you will be refunded that lesson and receive your next lesson at half price, to make up for the inconvenience we have caused you.

15. If your child attends After School Care, parents must arrange with After School Care to have their child brought to their lesson. They should arrive 5 minutes before their scheduled lesson time. Keyboardkidz will not be responsible if After School Care fails to bring your child to their lesson. Our teachers will endeavour to contact After School Care but cannot leave the teaching room to collect them. The office will let you know if After School Care is late or fail to bring your child to their lesson.

16. We reserve the right to update or change these terms and conditions at any time, you will be notified by email if this is to occur.
